Terms of Service

These Terms of Service (“Terms”) govern your use of the Tryton mobile application (the “App”), the website at trytonapp.com (the “Site”), and related web tools such as the organization admin portal, operated by TrytonApp (“Tryton,” “we,” “us,” or “our”). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

When you accept these Terms and our Privacy Policy at signup, we record the document versions and acceptance timestamps associated with your account.

1. Eligibility

You must be at least 18 years of age to use the App. By creating an account, you represent and warrant that you are at least 18 years old. We do not permit users under 18 to create accounts, including college or university students who are under 18.

The App is designed primarily for college and university students and student organizations. Organizations creating accounts should be affiliated with a recognized educational institution. Eligibility still requires that every individual user is 18 or older.

The App is intended for use only within the United States. By using the App, you represent that you are located in the United States. We do not target or provide services to users outside the United States, and we make no representations that the App is appropriate or available for use in other locations. If you access the App from outside the United States, you do so at your own risk and are responsible for compliance with local laws.

2. Accounts

You may create an account using an email address and password or, where offered, using Sign in with Google or Sign in with Apple. If you use Google or Apple sign-in, your use of that feature is also subject to that provider's applicable terms and policies, and you are responsible for the security of your Google or Apple account. How we collect, use, and share information from third-party sign-in is described in our Privacy Policy.

  • You are responsible for maintaining the confidentiality of your login credentials (including your Google or Apple account, if you use social sign-in) and for all activity that occurs under your account.
  • You must provide accurate and complete information when creating your account and keep it up to date.
  • You may not share your account credentials or allow others to access your account.
  • Notify us immediately at support@trytonapp.com if you suspect unauthorized access to your account.

3. Organizations and Membership

3.1 Creating an Organization

When you create an organization, you become its Owner. As Owner, you are responsible for your organization's use of the App, including the conduct of administrators, advisors/observers, and members, and for any subscription purchased for the organization.

3.2 Joining an Organization

You may join an organization using a valid invite code. By joining, you consent to organization owners and administrators viewing your study session data (including session times, durations, zone activity, and pulse check outcomes when that feature is enabled), applying manual hour overrides, and—where Pro Plus or other features are enabled—entering or viewing grades/GPA information and creating accountability or fine records tied to your membership. You also understand that other members may see leaderboard information (names and hours) and active-studying names as described in our Privacy Policy.

3.3 Roles and Permissions

  • Owner — full control over the organization, subscription management, and the ability to promote or demote members
  • Admin — zone management, member reports, invite code management, manual hour overrides, and (where enabled) grades and fines tools
  • Member — start study sessions, view personal statistics, and participate in leaderboards
  • Advisor / Observer — read-only access to organizational analytics, members, zones, and (where enabled) grades-related views; not required to track personal study hours. For Greek organizations this role may be labeled “Advisor” in the App

4. Subscriptions and Payments

4.1 Free Tier

The Free tier includes up to 20 members, 2 study zones, and basic reporting. Free tier features may be updated at our discretion.

4.2 Pro Tier

The Pro tier is available for an annual payment of $149 per organization per year. Pro includes unlimited members, unlimited zones, custom zones, custom user tags, and weekly email reports. New organizations receive a 14-day free trial of Pro features.

4.3 Pro Plus Tier

The Pro Plus tier is available for an annual payment of $199 per organization per year. Pro Plus includes all Pro features plus in-app GPA tracking and grade input, GPA trend analytics, default member tags (such as At Risk and On Probation), compliance views by tag and member, and auto-assigned study hours based on GPA rules.

4.4 Founding Chapter Program

A limited number of early-adopter organizations (“Founding Chapters”) may qualify for a discounted rate of $119 per year for their first three years of subscription, billed annually. Founding Chapter pricing is locked as long as the subscription remains active and in good standing. This program is offered at our discretion and may be discontinued at any time for new applicants.

4.5 Payment Channels

Paid tiers (Pro, Pro Plus, and qualifying Founding Chapter plans) may be purchased through different channels. The channel you use determines renewal and refund rules:

  • Web / Stripe. Purchases completed through Stripe checkout or Stripe payment links on the Site or related web flows are generally billed as an annual payment for access for one year from the purchase date and do not auto-renew unless we clearly state otherwise at checkout. We do not store your payment card details; Stripe processes the payment.
  • In-app (Apple App Store / Google Play via RevenueCat). Purchases made in the App through Apple or Google are typically auto-renewable subscriptions. They renew automatically at the end of each subscription period until you cancel in your device's subscription settings (iOS Settings → Apple ID → Subscriptions, or Google Play → Payments & subscriptions). Payment is charged to your Apple ID or Google account. You may manage or restore purchases through the App's billing / Customer Center features where available. Apple's and Google's terms also apply to these purchases; if there is a conflict with these Terms regarding the store purchase itself, the applicable store's mandatory terms control for that purchase channel.

When a paid subscription expires or is cancelled and not renewed, the organization is downgraded to the Free tier. Existing data is preserved but features exceeding Free tier limits become read-only or otherwise limited as described in the App.

The individual who completes a purchase (Owner or other authorized purchaser) agrees to these Terms on behalf of the organization for that subscription.

4.6 Trials

New organizations may receive a 14-day free trial of Pro features. Unless you purchase a paid plan before the trial ends, the organization reverts to Free tier limits. If you start a paid auto-renewable subscription through Apple or Google that includes a store-managed trial, conversion and billing follow the store's trial and subscription rules shown at purchase.

4.7 Refunds

  • Stripe / web purchases. Because these are typically one-time annual payments, we evaluate refund requests on a case-by-case basis. Requests made within 14 days of purchase will generally be honored. Contact support@trytonapp.com.
  • App Store / Google Play purchases. Refunds are primarily handled by Apple or Google under their respective refund policies. Request a refund through the store that processed your payment. We may assist with entitlement questions but cannot guarantee store refunds.

4.8 Price Changes

We may change pricing with at least 30 days' notice where we control the listed price. For in-app subscriptions, price changes may also be subject to Apple or Google rules and notifications. Price changes do not affect an already-paid period until the next renewal or repurchase, as applicable.

4.9 Academic Features Disclaimer

GPA tracking, grade input, and related Pro Plus tools are organizational aids only. They are not official transcripts, registrar records, or academic advising. Your organization is responsible for the accuracy of grades entered and for fair, lawful use of those features. Tryton does not verify grades with your school.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Falsify location data, spoof GPS coordinates, or otherwise circumvent geofencing verification
  • Circumvent or ignore pulse checks, timers, or session rules when your organization requires them (for example by manipulating the App, device time, or automation) in order to obtain credit you did not earn under those rules
  • Create fraudulent study sessions or manipulate study hour records
  • Enter false grades, misuse GPA or fine features to harass members, or use organizational tools for purposes unrelated to legitimate organization programs
  • Attempt to gain unauthorized access to other users' accounts, organizations, or our systems
  • Use automated tools, bots, or scripts to interact with the App without our written permission
  • Interfere with or disrupt the App, servers, or networks connected to the App
  • Harass, abuse, or harm other users through the App
  • Reverse engineer, decompile, or disassemble any part of the App

We reserve the right to suspend or terminate accounts that violate these terms.

6. Location Services and Study Sessions

The App uses your device's location services to verify presence in study zones and to support active study sessions. While a session is running, the App may request background or “Always” location so zone checks and your organization's session rules (including pulse checks) can be evaluated when the App is not in the foreground. Background location is used only in connection with an active session and stops when the session ends or you log out, as described in our Privacy Policy.

You may revoke location or notification permissions at any time through your device settings. Revoking permissions may prevent you from starting new study sessions or may limit how reliably sessions and pulses are enforced until you grant them again and open the App. Denying background or “Always” location may mean some rules only apply when the App is open.

Session times and outcomes are determined according to the App's logic and server-side rules, including when you are offline or reconnect later. You agree that missed pulses, zone exits, background limits, or connectivity issues may end or adjust a session as the service is designed to do.

7. Intellectual Property

The App, including its design, code, features, and content, is owned by TrytonApp and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for its intended purpose. You may not copy, modify, distribute, or create derivative works based on the App.

8. User Content

You retain ownership of data you provide (organization names, zone names, etc.). By using the App, you grant us a limited license to use, store, and process this data solely to provide and improve the service. We will not use your data for advertising or sell it to third parties.

9. Disclaimers

EXCEPT WHERE PROHIBITED BY APPLICABLE LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. GPS ACCURACY DEPENDS ON YOUR DEVICE AND ENVIRONMENT; WE ARE NOT RESPONSIBLE FOR INACCURATE LOCATION READINGS.

Tryton is a study tracking tool, not an academic compliance system or official transcript service. Organizations are responsible for their own policies regarding study hour requirements, grades, and fines. We do not verify the quality or nature of study activity or the accuracy of grades entered by organization officers.

WE DO NOT GUARANTEE DELIVERY OR TIMING OF LOCAL OR PUSH NOTIFICATIONS OR THAT THE APP WILL RUN IN THE BACKGROUND ON EVERY DEVICE OR OS VERSION; SESSION AND PULSE OUTCOMES MAY STILL APPLY BASED ON SERVER TIME AND IN-APP PROCESSING WHEN YOU USE THE SERVICE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRYTONAPP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF STUDY HOUR RECORDS, OR INACCURATE LOCATION TRACKING.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $149, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, our liability is limited to the fullest extent permitted by applicable law. Nothing in these Terms limits liability that cannot legally be limited, including where applicable law does not permit exclusion of liability for gross negligence, fraud, or willful misconduct. The foregoing does not limit any non-waivable rights you may have under consumer protection or other laws in your jurisdiction.

11. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless TrytonApp and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App, violation of these Terms, or infringement of any third party's rights.

12. Termination

  • By you — You may delete your account at any time from the App (Profile → Danger Zone → Delete Account) or by contacting us at support@trytonapp.com. Deletion will remove your personal data as described in our Privacy Policy.
  • By us — We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law. We will make reasonable efforts to notify you before termination, except in cases of severe violations.
  • Effect of termination — Upon termination, your right to use the App ceases. Sections 9 (Disclaimers), 10 (Limitation of Liability), 11 (Indemnification), and 13 (Dispute Resolution) survive termination. Cancelling an auto-renewable store subscription does not by itself delete your account; manage store subscriptions separately in device settings.

13. Dispute Resolution

We encourage you to contact us first at support@trytonapp.com to resolve any disputes informally.

Binding arbitration. If we cannot resolve a dispute informally within 30 days, either party may initiate binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified by this section. The AAA Consumer Arbitration Rules are available at adr.org. Arbitration shall take place in Ada County, Idaho (or remotely if the parties and AAA agree). The arbitrator may award the same damages and relief as a court, subject to these Terms. Each party pays its own attorneys' fees and costs unless the arbitrator awards otherwise under applicable AAA rules or law. This arbitration agreement is governed by the Federal Arbitration Act (FAA) to the extent it applies.

Class action waiver. You and Tryton agree that disputes will be resolved only on an individual basis. Class arbitrations, class actions, representative actions, and consolidation with other parties' claims are not permitted, except where such a waiver is prohibited by applicable law (in which case that portion shall not apply).

Small claims & injunctive relief. Either party may bring a qualifying dispute in small claims court in Ada County, Idaho (or your county of residence if permitted by that court's rules). Either party may also seek temporary or preliminary injunctive relief in a court of competent jurisdiction in Idaho to protect intellectual property rights or to prevent unauthorized access to the App, without waiving the right to arbitrate the underlying dispute.

30-day opt-out. You may opt out of this arbitration agreement by sending written notice to support@trytonapp.com within 30 days of first accepting these Terms, with the subject line “Arbitration Opt-Out” and your name and the email address associated with your account. Opting out does not affect other provisions of these Terms.

These Terms are governed by the laws of the State of Idaho, United States, without regard to conflict-of-law principles, except that the FAA governs this arbitration section where it applies.

14. Force Majeure

We will not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of war or terrorism, pandemics, power outages, internet or telecommunications failures, government actions, or third-party service provider outages.

15. General Provisions

15.1 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

15.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TrytonApp regarding the App and supersede all prior agreements, understandings, and communications, whether written or oral. Apple and Google may impose additional terms for in-app purchases as described in Section 4.5.

15.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of TrytonApp.

15.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, sale of assets, or by operation of law.

15.5 Electronic Communications

By using the App, you consent to receive electronic communications from us, including emails and in-app notifications. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing. Acceptance of these Terms and our Privacy Policy at signup is logged with version and timestamp as described in our Privacy Policy.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and may notify you through the App or via email. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the changes, you should stop using the App.
